What I have managed to figure between me and my hosting company is that I am going to set up a subdomain and copy all my existing files accross. It will allow me to upload my new theme and develop away and then when its finished transfer the new files accross and remove the subdomain. So I hope this works.

Yes, it is a paid theme…. Already contacted the vendor but unfortunately they couldn’t help as they no longer support the theme.
