Given that all themes are released under GPL, there is not a lot you can do about this – other than discuss it with your chosen developers.

Let’s say $1,000 for a non-exclusive theme. $3,000 for exclusive theme.

Those numbers were just examples, I have no idea how much he is paying. He could offer more for exclusivity.

Cost of designing and development aside that is.
There’s things like NDA’s, commercial greements, etc, but without knowing a whole lot more about your business, where you’re located, who you’re dealing with, where they’re located, etc, etc, etc… this is not the place for asking that sort of question.
What you need to do is bite the bullet and spend the money to see a real copyright lawyer that can give you a real answer to your questions and tell you what you should and should not do.
