Fieldset empty legend issue

If no text is entered in to the legend field of a Fieldset, instead of outputting nothing at all, it is outputting a non-breaking space on the page, ie  , which is causing an empty line to appear at the top of the fieldset, thus resulting in unwanted extraneous space at the top.

Could this behaviour please be adjusted so that, if a legend is empty, nothing is output? This also applies to other instances, such as the Verification fieldset.
