So you’re receiving this exact error?

Fatal error: Call to a member function get() on a non-object in ../wp-includes/query.php on line 28

What line exactly did you comment out?

The FAQ on my site for Cherry Framework based sites doesn’t say to comment out anything… it gives an example of how the code should be written so it does not break WordPress.

Is the Benevolence theme a Cherry Framework based theme? If it is, the theme dev should update the framework since the Cherry devs fixed this quite a while ago. If the theme dev can update the framework they can provide you with an theme update which will fix the issue. Seems there was a recent update to the theme. Are you running the latest version? If not, you should update because they may have already fixed this issue in their code.

Have you tried contacting their support? If they are unable or unwilling to help, please open a new support ticket in our support forums. I’ll be able to better assist you there.

    Hope this helps!
