It sounds like you tried to install this using the them installer, but it is a plugin. You can install it from the plugin installer.

No worries, I’m kind of shocked that WordPress doesn’t check if a theme that fails validation, would pass validation as a plugin and if so switch installers or at least point out the mistakes. You can’t be the first person to have made this mistake.
