    We are developing a new WordPress site for a client with an existing WordPress site. His current provider will not provide him with administrative access to his site or access to the export.php function that would enable him to export existing content.

    Does this go against the WordPress GPL, which states:

    “If you distribute copies of such a program, whether gratis or for a fee, you must give the recipients all the rights that you have. You must make sure that they, too, receive or can get the source code.”

    I am not an expert in Law, but what the GPL license talks about is if your distributing the software all others the same freedom as you have been given which you can modify the code and also redistribute the same (under a compatible license).

    Now the previous developer wasn’t really distributing code to anyone. He used code for the end client, the client should take legal recourse as customer, where he (assuming) has paid for something and isn’t got the product.

    No, it doesn’t. It’s not very nice but there’s no GPL issue here.
