Sorted, I had the checkout page disabled, and was going straight from the cart page to paypal express. (my bad)

This is exactly the problem, it was there but has disappeared since updating to WC 2.1.2, and I can’t find a setting for it anywhere.
order notes is there but there is no way that I can find for a customer to add a note. do you know how to enable this function?
