After much digging, we found out that this needs to be switched via PxPay to work.

Just go to the WPML “Languages” page from the side nav and then go down to “Language switcher in the WP Menu” and tick “Display the language switcher in the WP Menu” and select your WordPress menu from the drop down box.
You could also select “Language switcher style – Drop-down menu” as “Mobile Friendly” as well.

the site isn’t live yet, but we have had to go with another option as we couldn’t get it to work, and we were using Fancybox

could it be a php4 issue, we found out the server is running php4 not php5cheers
