In reply to: Free Premium Theme – Intrepid – Now Available@evesblog, check to see if your /wp-content/themes/intrepidity/uploads/ folder is writable (i.e. 0755). You can change the folder’s permission by FTP program or your web host’s file manager.

Regardless of which site you download it from, its CSS, XHTML and design is released under GPL, as the theme homepage clearly states:
